have and will take responsibility for their action and therefore they had free will and they're going to take the consequences for that. the problem is when we start actually believing the rhetoric, we actually start believing what we're saying, if you think that, if you use free will normatively, used as a value judgment about when somebody should have to take responsibility and you use it that way in the criminal law, what happens is it starts bleeding over into what i call thequasi- criminal law which is civil commitment. in the civil commitment area, we also use this notion of free will that we generally call volitional control, but we use it in the classic example today because it's so high profile are sexually violent predators. sexually violent predators under constitution the supreme decisions in kansas versus hendricks and kansas versus crane, the supreme court said that under the constitution in order to civilly commit, to not criminally, but to civilly commit a sexually violent predator, you have to demonstrate two independent factual constructs. one is you have to demonstr

. it just gets a little circular, but i do agree that support should include actions or statements whether public or non-public. that are trying to urge or encourage a particular outcome. i think that is the point of "support." and i'm also trying to think through if you have got a committee under state law that you have a primarily formed committee. i know. right. that this is creating a new animal only under scintilla, but is requiring that animal to file reports. all right, i will just keep thinking about it. if we haven't figured out the definitions we should try to get that right. it's dangerous to have a definition here that is complicated and interconnected and say that the commission may further adopt presto clarify this. i think we should get it right and not rely on having to go back later and define by regwhere we already have a definition that is intended to be comprehensive. >> because we so seldom try to do things right the first time? >> we should try. i'm being supportive. i will shut up for a while. >> i think commissioner studley is correct that the issue of the words

long we have used politics and the second amendment to cover up our lack of action. yes, the supreme court affirmed we have a right to bear arms, but in that same ruling the court made clear that right is not unlimited. we do not, as justice scalia put it, have an unlimited right to keep and carry any weapon whatsoever in any manner whatsoever for whatever purpose. our individual right to bear arms is limited by a right among others to keep our children safe. any of those children could have been one of ours and for 20 parents, it was. we may not be able to stop every crime, we know that no single law or set of laws can prevent every act of senseless violence in our society, but we have the ability and the no-how to prevent many of them. we must simply find the courage. we can no longer be bystanders to injustice. we cannot continue to look on and do nothing. as shakespeare said, the fault lies not within our stars but in ourselves. we must act. thank you. i yield back. the speaker pro tempore: the gentleman yields. the chair recognizes the gentleman from washington, mr. mcdermott, f

line. it says if you engage in a wongful action, there is a defense called the insanity defense which never works as most of us know because we don't recognize it. should we recognize it, that's an interesting question. should we have a more robust concept of diminished responsibility in light of the understanding that some people have less control over their preferences and desires or should we have better sentencing schemes or get rid of incarceration and come up with different models of trying to deal with punishment once we understand people have wrong selections. i think those are all interesting questions, but is there free will? well, the fact that almost everybody in the audience raised either their right or left hand contemplated it and were quickly able to act and respond. that to me says, yes, there is. now what do we want to do about it? now that we understand that those of us in the audience or up here that like chocolate cake may not have control over it, how do we want to account for that if at all in the criminal justice system? to date, we haven't. in the future, we m

by executive action or legislative action, we will convene such a commission. but, mr. president, i want to make very clear i am not offering this idea as a substitute for any action that we can take now, any action that the president can take now, for instance, with regard to the existing laws that are aimed at preventing people who shouldn't have guns from having them, keeping guns that really are military and are not part of hunting or sports shooting off the market. anything the president can do, anything congress can do. now, i would support a restoration of the assault ban today. these are weapons developed by our military originally, not by private industry for hunting or sport shooting purposes. they shouldn't be sold. we have got the background checks in the brady bill. if you attempt to buy a gun from a licensed federal firearms dealer, why shouldn't that exist for people who would buy a gun at a gun show, where incidentally terrorists we know have bought guns. so anything we can do quickly we ought to do. but i also think that a commission will make sure that we won't let the

, conservative groups have already condemned his harder bargain. heritage action called it the grand capitulation. republicans rm urged not to concede on the debt ceiling. mean whooit on the left, the huffington post, there's a headline condemning obama's raw deal saying the president's offer targets the middle class and the elderly. it's the cpi index they're taking issue with. the way you used to be able to get a deal done in washington is quote/unquote if both sides complained. that means there was equal pain. the question is if that still applies today. we'll see. there has to be some movement here. is the threshold going to get moved up? how will the rank and file respond to speaker bain they are morning? he's not presenting them any plan, but when the update is done. and what happens? where are senate republicans? some of them are in a sour place. when do they decide to launch their quote/unquote plan bs, which would extend tax rates up to 250,000 and punt everything else? we'll see. the next 24 hours are everything. they have to get a deal, a framework in place to avoid any sort of punt. >
